About This Policy

Chasing Your Dreams LLC, known as Chasing Your Dreams ABA (“CYD,” “we,” “us,” or “our”), explains in this policy how we collect, use, and disclose personal information through https://www.chasingyourdreamsaba.com (the “Website”) and related inquiries and communications.

This policy covers Website visitors, parents and guardians seeking services for a learner, authorized caregivers and referring professionals, and people contacting us about employment. It describes public Website information and inquiry handling. Clinical records, treatment, billing, and other health care activities may also be governed by a separate HIPAA Notice of Privacy Practices and other required notices.

Where information is protected health information under HIPAA, applicable law and our Notice of Privacy Practices govern its use, disclosure, and associated rights. Health information submitted through a public form can still receive those protections. This policy does not replace a Notice of Privacy Practices, authorize a disclosure that requires separate authorization, or reduce rights under applicable law. Contact us for the notice applicable to your information.

Information You Provide

We collect information you choose to provide through the Get Started form or in related communications. Depending on your interaction, this includes:

  • A parent’s, guardian’s, or other contact person’s name, telephone number, email address, and preferred contact method.
  • The learner’s age and county, whether the learner currently has an autism diagnosis, and the insurance provider’s name.
  • Interest in home, school, or community services, questions about services, and information you include in a message.
  • Scheduling information, follow-up correspondence, and records of communication preferences or consent.
  • For employment inquiries, contact details, the position of interest, and résumé, qualifications, work history, or other application information you choose to send.

Fields marked required are needed for the online form; other fields are optional. You may contact us by telephone instead of using the form. If needed information is missing, we may be unable to fully answer an inquiry or determine the next step.

A diagnosis selection, service request, or message may reveal sensitive health information about a child or another person. Provide only the details needed for the initial inquiry. Do not include Social Security numbers, payment details, insurance member numbers, full evaluations, school records, or detailed medical records in a general form or ordinary email. We can arrange an appropriate method for records we need.

If you submit information about another person, you must have the authority or other lawful basis to do so. We may need to verify a representative’s authority before discussing information or acting on a request.

Information From Other Sources

In responding to an inquiry, we may receive information from a parent, legal guardian, authorized representative, or referring professional. When needed to evaluate services or coverage, we may receive information from an insurer or another provider, as permitted by law and subject to any required authorization. Health information obtained for assessment, treatment, or billing is also subject to the applicable health privacy notice and law.

Technical Information and Cookies

When you visit the Website, we and providers operating it may collect an IP address, browser and device type, operating system, referring page, pages requested, visit times, and error or security logs. An IP address may indicate an approximate location.

Cookies and similar technologies may support basic Website functions, security, and preferences. Cookies are small files stored on your device. Other technologies may store browser information or transmit technical information when content loads. Our Website does not use advertising pixels, session replay, or optional analytics tools.

You can use your browser settings to block or delete cookies. This may affect some features. If we introduce optional technologies, we will update the relevant disclosures and provide any choices or consent mechanisms required before using them. A cookie choice or acceptance of this policy is not a HIPAA authorization.

How We Use Information

We use information as appropriate to your interaction and as permitted by applicable law to:

  • Respond to inquiries, explain ABA services, and discuss a learner’s needs, location, and possible next steps.
  • Coordinate intake, identify required documentation, verify coverage where appropriate, and communicate about scheduling or service availability.
  • Review employment inquiries and application materials and communicate with applicants.
  • Operate, maintain, troubleshoot, and protect the Website and communication systems.
  • Maintain records, honor communication preferences, address disputes, and meet legal obligations.

If you separately request or agree to receive updates about our services or opportunities, we may send those communications as permitted by law and consistent with your choices. We obtain additional consent or authorization when required for a particular use. The uses described here do not authorize us to use protected health information for marketing where HIPAA authorization is required.

How We Disclose Information

We disclose information only as appropriate for the purposes described here and subject to applicable restrictions. Recipients may include:

  • Providers that help host and maintain the Website, protect systems, process inquiries, deliver communications, or support recruiting. They receive information needed for their work, subject to applicable contractual and legal restrictions. Where required for protected health information, we use business associate agreements.
  • Insurers, health care providers, or authorized representatives when needed to address an inquiry, coordinate intake, or verify coverage, as permitted by health privacy law and any required authorization. A Website inquiry does not by itself authorize disclosure of records to a school or other third party.
  • Professional advisers, including lawyers and accountants, when needed for their work and permitted by law.
  • Authorities or other recipients when required by law or valid legal process, or to protect rights, safety, or security within legal limits. Additional restrictions apply to protected health information.
  • Parties involved in a proposed or completed business transaction, such as a merger or sale, subject to confidentiality protections and applicable restrictions on health information.
  • Recipients you direct us to contact or authorize us to share with, subject to verification and any authorization requirements.

We do not sell personal information or share it for cross-context behavioral advertising or targeted advertising. We do not disclose a learner’s diagnosis, inquiry details, or other health information to advertising platforms for ad targeting. These statements do not prevent the limited service-provider disclosures described above.

Your Communication Choices

You may choose not to provide optional information or use the online form. Contact us if you prefer a different method of communication or need assistance.

Providing a telephone number or selecting “Text” as a preferred contact method allows us to understand how you want a response about your inquiry. It does not by itself provide consent to automated marketing calls or texts. Any messaging program requiring separate consent will present the relevant terms and choices at enrollment. You may tell us to stop texts or change contact methods at any time, including by replying STOP to a text where supported or contacting us directly.

You can unsubscribe from marketing emails using the instructions in those emails or by contacting info@chasingyourdreamsaba.com. We may still send necessary nonmarketing communications about an inquiry or existing relationship, consistent with your rights and communication preferences. Ordinary email and text may not be suitable for detailed health information; ask us about an appropriate channel.

Privacy Requests and Rights

Depending on where you live, the information involved, and the laws that apply, you may have rights to access, correct, delete, or receive a copy of personal information; withdraw consent; or opt out of certain uses or disclosures. Some laws also provide rights to restrict or object to processing, appeal a denied request, or complain to a regulator. These rights are subject to legal conditions and exceptions. We honor legally required opt-out preference signals for processing to which they apply.

To make a request, email info@chasingyourdreamsaba.com with “Privacy Request” in the subject line, call 336-880-4040, or write to the mailing address below. Describe the request and how we can reach you. We may request information reasonably necessary to verify identity or an authorized representative’s authority. Do not send identity documents or detailed health records unless we arrange an appropriate channel.

We respond within the time required by applicable law and explain a denial as required. Where an appeal right applies, contact the same email address with “Privacy Appeal” in the subject line. We will not unlawfully discriminate or retaliate against you for exercising privacy rights. Withdrawal of consent does not affect processing that was lawful before withdrawal.

Requests involving health records are handled under the applicable Notice of Privacy Practices and health privacy laws. Those rules may provide access, amendment, confidential communication, and other rights, but do not generally require deletion of medical records on request. Parents’ and representatives’ access depends on their legal authority and applicable exceptions. Contact us to route a request to the appropriate person.

Children and Learner Information

Our services support children and adolescents, but the public Website’s inquiry features are intended for adults seeking information or acting for a learner. The Website is not directed to children under 13 for their own use, and we do not knowingly collect personal information directly from children under 13 through it.

We do collect information about learners that parents, guardians, or other authorized people provide, including the age and diagnosis information described above. This is different from inviting children to submit information themselves. If you believe a child has submitted information directly without appropriate authorization, contact us so we can investigate and take appropriate action, including deletion where required by law.

How Long We Retain Information

We retain information for as long as reasonably necessary for its purpose, taking into account the status of the inquiry or relationship, the information’s sensitivity, applicable clinical and employment recordkeeping requirements, security needs, and legal obligations or disputes. Information incorporated into a clinical record is subject to the retention rules for that record.

We may retain limited records of opt-out requests to honor your choices. When information is no longer needed, we delete or deidentify it, subject to applicable law and backup retention processes. We do not promise that every deletion request will result in immediate removal from all backups or legally required records.

How We Protect Information

We use administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, alteration, loss, or disclosure. Safeguards are selected according to the information and applicable obligations. No transmission method, website, or storage system is completely secure. This limitation does not waive our legal responsibilities, including required breach notifications.

Other Websites and Services

The Website may link to independently operated resources or recruiting services. Those services may collect information under their own privacy notices. If third-party content is embedded, the provider may receive technical information when it loads or when you interact with it. Review the notices and choices presented by those services.

This policy does not govern a third party’s independent activities. Providers handling information on CYD’s behalf remain subject to our applicable contractual and legal obligations.

Where Information Is Processed

CYD operates in North Carolina, United States. Information is processed where CYD and its service providers operate. Processing locations depend on the services used; contact us for information about locations relevant to your inquiry. We apply safeguards required by applicable law for any international transfer. Use of the Website alone does not waive privacy protections or provide consent where a separate transfer consent is required.

Changes to This Policy

We may update this policy to reflect changes in our practices or legal requirements. We will post the updated policy and revise the date above. For material changes, we will provide additional notice and obtain consent or authorization where required. Changes do not override commitments we are legally required to honor for information already collected.
